Many employers are trying to understand how the Families First Coronavirus Response Act (FFCRA) paid leave mandates for school closures apply to the various teaching options and schedules as schools reopen. The Department of Labor (DOL) has updated its Q&A (see questions #98-#100) to address some of these questions.
Below is a brief summary:
- If a school provides the choice between having the child attend in person or participate in remote learning and the parent/employee chooses remote learning, FFCRA does not apply (school not considered closed).
- If a school offers hybrid learning which includes in-person and remote learning, FFCRA would apply to the remote learning days.
- If a school offers only remote learning, the school is considered closed for FFCRA purposes.
